{"id":10784,"date":"2025-11-28T15:55:05","date_gmt":"2025-11-28T14:55:05","guid":{"rendered":"https:\/\/meine-renditeimmobilie.de\/?p=10784"},"modified":"2025-11-28T15:55:05","modified_gmt":"2025-11-28T14:55:05","slug":"is-the-central-asset-register-for-all-eu-citizens-coming","status":"publish","type":"post","link":"https:\/\/meine-renditeimmobilie.de\/en\/is-the-central-asset-register-for-all-eu-citizens-coming\/","title":{"rendered":"Planned since 2021: Is the central asset register for all EU citizens coming?"},"content":{"rendered":"<p style=\"font-weight: bold\">\r\n\tUnder the label &#8220;EU asset register&#8221;, the idea has been circulating for some time that the European Union wants to record in a gigantic database <em>all<\/em> assets of its citizens: from bank accounts and real estate to gold, art, and cryptocurrencies.\r\n<\/p>\r\n<p style=\"font-weight: bold\">\r\n\tIn blogs, law firm newsletters, and YouTube videos, this often sounds like an imminent &#8220;total register&#8221; with direct access to each individual&#8217;s private assets.\r\n<\/p>\r\n\r\n<section>\r\n\t<h2>EU Asset Register \u2013 what is really behind it?<\/h2>\r\n\r\n\t<p>\r\n\t\tThe reality is more nuanced: Since 2021, there has in fact been a political project for a European asset data infrastructure (&#8220;EU asset registry&#8221;) \u2014 but so far <strong>no adopted EU regulation<\/strong> that introduces a central, complete asset register for all citizens. Instead, the following exist:\r\n\t<\/p>\r\n\r\n\t<ul>\r\n\t\t<li>\r\n\t\t\ta comprehensive <strong>feasibility study by the EU Commission<\/strong> (published in 2024),\r\n\t\t\t<a href=\"https:\/\/op.europa.eu\/de\/publication-detail\/-\/publication\/050b047e-3ff5-11ef-865a-01aa75ed71a1\" target=\"_blank\" rel=\"nofollow\">feasibility study 2024<\/a>;\r\n\t\t<\/li>\r\n\t\t<li>\r\n\t\t\tan already adopted <strong>EU anti-money laundering package (AMLR, AMLA regulation, etc.)<\/strong> with obligations to aggregate information on certain assets and high-value goods,\r\n\t\t\t<a href=\"https:\/\/www.europarl.europa.eu\/news\/de\/press-room\/20230327IPR78511\/new-eu-measures-against-money-laundering-and-terrorist-financing\" target=\"_blank\" rel=\"nofollow\">AML measures 2023<\/a>;\r\n\t\t<\/li>\r\n\t\t<li>\r\n\t\t\tand an ongoing political and societal <strong>debate<\/strong> about the purpose, limits, and risks of a comprehensive asset register.\r\n\t\t\t<a href=\"https:\/\/www.delorscentre.eu\/en\/publications\/detail\/publication\/eu-asset-register\" target=\"_blank\" rel=\"nofollow\">Delors policy brief<\/a>\r\n\t\t<\/li>\r\n\t<\/ul>\r\n\r\n\t<p>\r\n\t\tThe following provides an overview along the requested points \u2013 including an honest assessment of how likely such a system is to be implemented and who would be most affected by it in practice.\r\n\t<\/p>\r\n<\/section>\r\n\r\n<section>\r\n\t<h2>Who initiated the EU asset register?<\/h2>\r\n\r\n\t<h3>Political origin in the European Parliament<\/h3>\r\n\t<p>\r\n\t\tThe first concrete step was not a &#8220;secret plan of the EU Commission&#8221; but an <strong>official mandate from the European Parliament<\/strong>: On 3 December 2021, the Commission put a feasibility study out to tender. This\r\n\t\t<a href=\"https:\/\/www.europarl.europa.eu\/doceo\/document\/E-10-2024-001435_EN.html\" target=\"_blank\" rel=\"nofollow\">parliamentary question 2024<\/a>\r\n\t\tshows that the mandate was explicitly initiated by the Parliament.\r\n\t<\/p>\r\n\t<p>\r\n\t\tThe project was awarded to a consortium led by the Centre for European Policy Studies (CEPS). The idea was supported by NGOs and think tanks \u2014 such as the Delors Centre \u2014 which advocated transparency and asset oversight as tools against tax evasion, money laundering, and corruption.\r\n\t<\/p>\r\n\r\n\t<h3>Role of the EU Commission and the new authority<\/h3>\r\n\t<p>\r\n\t\tThe EU Commission took on the mandate and carried out the study \u2014 but emphasizes that this <em>does not constitute an obligation<\/em> to actually introduce a register at a later stage.\r\n\t<\/p>\r\n\t<p>\r\n\t\tWith the new legal framework in the area of anti-money laundering, the Anti-Money Laundering Authority (AMLA) was created, partly as a central supervisory and coordinating authority for the Member States. Many commentators see AMLA as a potential technical hub \u2014 at least for register-based data queries.\r\n\t<\/p>\r\n<\/section>\r\n\r\n<section>\r\n\t<h2>What would an EU asset register contain?<\/h2>\r\n\r\n\t<h3>Scenarios in the feasibility study<\/h3>\r\n\t<p>\r\n\t\tAccording to the official study from July 2024, three different scenarios are examined \u2014 with different intensities and technical scopes. This\r\n\t\t<a href=\"https:\/\/op.europa.eu\/de\/publication-detail\/-\/publication\/050b047e-3ff5-11ef-865a-01aa75ed71a1\" target=\"_blank\" rel=\"nofollow\">asset registry study<\/a>\r\n\t\tdistinguishes:\r\n\t<\/p>\r\n\r\n\t<ul>\r\n\t\t<li><strong>Scenario 1:<\/strong> New national registers for specific types of assets \u2014 and linking them at EU level.<\/li>\r\n\t\t<li><strong>Scenario 2:<\/strong> Existing national registers are interconnected via a central EU access portal.<\/li>\r\n\t\t<li><strong>Scenario 3:<\/strong> Actual creation of a central, EU-wide asset register.<\/li>\r\n\t<\/ul>\r\n\r\n\t<p>\r\n\t\tAccording to the study, asset types that frequently play a role in money laundering, tax evasion, or complex financial structures are considered &#8220;relevant&#8221;. This\r\n\t\t<a href=\"https:\/\/thenomadtax.com\/en\/2024\/12\/eu-asset-register\/\" target=\"_blank\" rel=\"nofollow\">overview of possible asset types<\/a>\r\n\t\tmentions bank accounts, securities accounts, real estate and land, corporate shareholdings, high-value goods (yachts, aircraft, luxury cars, art), crypto assets, precious metals, and safe deposit boxes.\r\n\t<\/p>\r\n\r\n\t<h3>What already exists?<\/h3>\r\n\t<p>\r\n\t\tEven today, there are certain registers and registration obligations at EU level or in many Member States that are seen as building blocks of a larger system. These include transparency or beneficial ownership registers, account registers, land registers, company and commercial registers, securities accounts, etc.\r\n\t<\/p>\r\n\t<p>\r\n\t\tNew \u2014 and part of the anti-money laundering package adopted in 2023\/2024 \u2014 are extended reporting obligations for certain high-value goods. In the public debate, these changes are sometimes described as a &#8220;covert asset register&#8221;, even though no unified register exists in legal terms.\r\n\t<\/p>\r\n<\/section>\r\n\r\n<section>\r\n\t<h2>Purpose: What is it all for?<\/h2>\r\n\r\n\t<p>Officially, three main objectives are stated:<\/p>\r\n\r\n\t<ul>\r\n\t\t<li>\r\n\t\t\t<strong>Combating money laundering and terrorist financing:<\/strong>\r\n\t\t\tIn cases of suspicion, authorities should be able to obtain\r\n\t\t\t<a href=\"https:\/\/finexity.com\/en\/blog\/eu-asset-register-the-end-of-privacy-or-the-beginning-of-combating-money-laundering\" target=\"_blank\" rel=\"nofollow\">\r\n\t\t\t\teasier and cross-border access to relevant asset data\r\n\t\t\t<\/a>.\r\n\t\t<\/li>\r\n\t\t<li>\r\n\t\t\t<strong>Combating tax evasion and aggressive tax avoidance:<\/strong>\r\n\t\t\tDisclosure and transparency are intended to make assets visible that are concealed via offshore structures or complicated company constructs.\r\n\t\t<\/li>\r\n\t\t<li>\r\n\t\t\t<strong>Enforcement of sanctions and confiscation of illegal assets:<\/strong>\r\n\t\t\tEspecially in times of crisis, an EU-wide overview of assets is meant to help locate, freeze, or confiscate assets.
