The amount of the annuity depends on the property value, age, statistical life expectancy, and the value of a reserved right of residence. \r\n<\/p>\r\n<p style=\"font-weight: bold\">\r\n\tAnyone considering a life annuity should compare offers, understand the calculation, agree on land register protections (real charge \/ Reallast) and a value guarantee clause \u2013 and be aware of alternatives such as partial sale, reverse mortgage, or usufruct.\r\n<\/p>\r\n\r\n<section>\r\n\t<h2>What is a life annuity? Definition and meaning<\/h2>\r\n\t<p>\r\n\t\tBy definition, a life annuity is a regularly recurring, uniform payment promised for the lifespan of a person (&#8220;upon the life&#8221;). The widow&#8217;s pension is also a life annuity \u2013 albeit a so-called abbreviated life annuity, because it can end upon remarriage.\r\n\t\t<\/li>\r\n\t\t<li>\r\n\t\t\t<strong>Corporate succession and agriculture:<\/strong> Businesses, farms, or companies are sometimes transferred in exchange for a life annuity, for instance during a farm handover to the next generation.\r\n\t\t<\/li>\r\n\t\t<li>\r\n\t\t\t<strong>Family-internal transfers:<\/strong> Parents transfer their house to their children in exchange for a life annuity, often in combination with a right of residence or usufruct.\r\n\t\t<\/li>\r\n\t<\/ul>\r\n\t<p>\r\n\t\tIn English, the German &#8220;Leibrente&#8221; is called &#8220;life annuity&#8221;. The model also exists in Austria and Switzerland, partly with differing tax rules \u2013 a brief overview follows at the end of the article.\r\n\t<\/p>\r\n<\/section>\r\n\r\n<section>\r\n\t<h2>How does the real estate life annuity work?<\/h2>\r\n\t<p>\r\n\t\tWhen selling a house on a life annuity basis, you sell your property to a buyer \u2013 this can be a commercial provider, a foundation, a private investor, or a family member. This provides liquidity, for example to settle debts or make the house age-accessible.\r\n\t<\/p>\r\n\t<p>\r\n\t\tIn addition, there are special forms such as the hire-purchase life annuity, where the buyer effectively pays off the property in installments while living there, as well as regional peculiarities \u2013 such as the traditional handover of a farm for a life annuity in Bavaria, Tyrol, or Austria, where the farm transferee promises the retiring farmers an annuity, right of residence, and often care services.\r\n\t<\/p>\r\n<\/section>\r\n\r\n<section>\r\n\t<h2>Calculating a life annuity: Formula, example, and calculator<\/h2>\r\n\t<p>\r\n\t\tHow is a life annuity calculated? The basic formula is simpler than many think. It only gets complicated with actuarial details. Simplified, the following applies:\r\n\t<\/p>\r\n\t<blockquote>\r\n\t\tMonthly life annuity = (Property value \u2212 Capital value of the right of residence) \u00f7 Annuity present value factor \u00f7 12\r\n\t<\/blockquote>\r\n\t<p>\r\n\t\tThe annuity present value factor (also called multiplier) reflects statistical remaining life expectancy and an interest rate. For a reliable calculation \u2013 for example via Excel using official multipliers \u2013 you should use the current present value factors from the Federal Ministry of Finance and, in case of doubt, involve an independent expert or the <a href=\"https:\/\/www.verbraucherzentrale.de\/wissen\/geld-versicherungen\/altersvorsorge\/immobilienverrentung-das-haus-verkaufen-und-trotzdem-darin-wohnen-42192\" rel=\"nofollow\" target=\"_blank\">Consumer Advice Center (Verbraucherzentrale)<\/a>. \r\n\t<\/p>\r\n\t<p>\r\n\t\tThe capital value or present value of a life annuity \u2013 important for estate settlements or gift tax \u2013 can also be determined using these official tables: Annual value of the annuity multiplied by the multiplier according to \u00a7&nbsp;14 BewG.\r\n\t<\/p>\r\n<\/section>\r\n\r\n<section>\r\n\t<h2>Life annuity and tax: How the life annuity is taxed<\/h2>\r\n\t<p>\r\n\t\tPrivate life annuities are taxable under <a href=\"https:\/\/www.gesetze-im-internet.de\/estg\/__22.html\" rel=\"nofollow\" target=\"_blank\">\u00a7&nbsp;22 No.&nbsp;1 EStG<\/a>, but not in full amount \u2013 <strong>only with the so-called income yield portion (Ertragsanteil)<\/strong>. If total income remains below the basic tax-free allowance, the life annuity ultimately remains tax-free.\r\n\t<\/p>\r\n\t<h3>Abbreviated life annuity: Definition and taxation<\/h3>\r\n\t<p>\r\n\t\tAn abbreviated life annuity is an annuity that runs at most for a lifetime, but is additionally limited in time \u2013 so it ends upon death or after the expiration of a maximum period, whichever occurs first. \r\n\t<\/p>\r\n\t<p>\r\n\t\tClassic examples are occupational disability pensions (which end upon reaching retirement age) and widow&#8217;s pensions (which can end upon remarriage). There you also declare a domestic life annuity from a private real estate sale.\r\n\t<\/p>\r\n\t<h3>Taxes for the seller: the 10-year period<\/h3>\r\n\t<p>\r\n\t\tIn addition to ongoing taxation of the annuity, the question arises whether the sale itself triggers tax. The decisive factor is the speculation period under <a href=\"https:\/\/www.gesetze-im-internet.de\/estg\/__23.html\" rel=\"nofollow\" target=\"_blank\">\u00a7&nbsp;23 EStG<\/a>: \r\n\t<\/p>\r\n\t<p>\r\n\t\tIf more than ten years elapse between acquisition and sale \u2013 or if you lived in the property yourself in the year of sale and the two preceding years \u2013, the capital gain remains tax-free. For most owner-occupied houses of older owners, the 10-year period has long since expired, so no tax is incurred on the sale.\r\n\t<\/p>\r\n\t<h3>Taxes for the buyer: Acquisition costs and income-related expenses<\/h3>\r\n\t<p>\r\n\t\tThe acquisition costs when buying against a life annuity correspond to the present value of the annuity obligation (plus ancillary costs) \u2013 this value forms the basis for depreciation if the property is rented out. \r\n\t<\/p>\r\n\t<p>\r\n\t\tIn addition, each annuity payment contains an interest portion (the income yield portion): If rented out, the buyer can deduct this interest portion as income-related expenses. Property transfer tax is also calculated on the present value of the life annuity (plus value of the right of residence, depending on structuring). \r\n\t<\/p>\r\n\t<p>\r\n\t\tIs the paid life annuity tax-deductible if the property is owner-occupied?
